Authorised representative for packaging in Austria

In general, the Austrian Packaging Ordinance distinguishes between obligated parties from EU states and third countries.

The legally defined term "producer" also includes importers, traders and resellers as obligated parties.

For producers without their own headquarters in Austria, there is a general obligation to register when selling to private end users, which must be carried out by an authorised representative to be appointed in Austria.

Producers from EU member states who sell to Austrian importers, sellers or commercial end-users (so-called primary obligated parties) can assume their obligation voluntarily as before.

For producers from non-EU member states, this option no longer exists as of 1st January 2023.

Single-use plastic products are included in the Austrian Packaging Ordinance. Thus, the obligation to appoint an authorised representative applies equally to these products.
